Terms of Service
Draft under legal review
This text is not in force yet and may still change. Highlighted brackets mark points that are still open.
- Version: 0.1 (draft)
- Date: 2026-10-14
- Applies from: [[PLACEHOLDER: effective date]]
1. Who we are and what these terms cover
hyad (hyad.app) is a hosting platform for small web apps: static sites and SvelteKit apps, each
with its own sign-in, database and file storage. hyad is run by
[[PLACEHOLDER: legal entity name]] ("hyad", "we"); our details are in the
imprint.
These terms apply when you create a hyad account, deploy or manage an app, buy credits or use
the hyad API, MCP server or portal (platform.hyad.app). They also cover people who only sign in
to an app hosted on hyad, as far as their hyad account is concerned (section 3.3).
Also part of these terms: the Acceptable Use Policy, the Refund and Cancellation Policy and, if you store data about other people in your apps, the Data Processing Agreement. How we handle your personal data is in the Privacy Policy.
2. Who may use hyad
- You must be at least 16 years old.
- hyad is for natural persons only: consumers, and sole traders (for example an eenmanszaak or a ZZP'er) acting for themselves. Legal entities (such as a BV, NV, foundation or association) cannot have an account, and you may not use hyad on behalf of an employer or another organisation.
- Rules marked consumers only apply only to people acting outside their trade or profession. Rules marked sole traders only apply if you use hyad for your trade or profession.
3. Accounts
- You sign up with an email address and password (the address must be confirmed before you can use the account), with GitHub or with Google. You can add passkeys.
- Keep your sign-in details safe. You are responsible for what happens under your account, including what AI assistants or tools you connect to it (for example over MCP) do on your instructions.
- One account for the platform and its apps. The same hyad account is used to sign in to apps hosted on hyad. When you sign in to an app, that app's owner receives your hyad user id, your email address and your role in that app; the app's sign-in screen says so. Who may use an app (its access list, roles and invitations) is decided by the app's owner. What the app then does with your data is the app owner's responsibility, not ours (see the Privacy Policy).
- We may refuse a sign-up, for example from disposable email domains or when sign-up limits per network or email domain are reached, to prevent abuse.
4. Your apps and content
- You keep all rights in the code, files and data you deploy or store ("your content"). You give us a licence to host, copy, transmit, display and back up your content only as far as needed to run hyad for you and for your app's visitors.
- You are responsible for your content and your apps, including what your apps do with their visitors' data. If your apps store personal data about other people (including your app's access list, roles and invitations), the DPA applies between you and us.
- New apps are private. Making an app public, or connecting a custom domain, publishes it on the internet under your responsibility.
- Each app has a private source repository that hyad creates and keeps for you ([[CHECK: on GitHub, in an organisation hyad controls]]).
- App names (the part before
.hyad.app) are given on a first-come basis. A name is yours while the app exists. After a Free app is deleted, its name is reserved for its previous owner for a period (currently 30 days) and cannot be claimed by others. A name under an admin hold (section 8) cannot be claimed by anyone, also after the app is deleted, until we release it. A released name starts clean: no hold carries over to whoever claims it next. - Name disputes. If an app name infringes someone else's rights (for example a trademark or a trade name), we may block, rename or reassign that name. We tell the owner first, with our reasons, 14 days before the change, or at once in case of clear abuse such as phishing or impersonation. This affects only the name: the app's content is kept and the account is not put on hold. You can contest it as in section 8.4.
5. Plans, credits and paid add-ons
[[CHECK: Billing is not live yet; the pricing page says testers use hyad free. Publish sections 5 and 6 only together with the pricing page that names the prices.]]
- Plans. hyad has a Free plan and a Pro plan. The limits of each plan (requests,
server CPU time, storage, database size and writes, number of apps, AI tool calls and
others) are listed on the pricing page (
https://hyad.app/pricing), which is part of these terms. Free has hard limits; new Free accounts get reduced limits for their first days. - Pro runs on prepaid credits. You buy credit packs (currently EUR 10, 25 or 50; USD 12, 30 or 60 for customers in the United States). While your account holds credits, Pro applies: usage up to the included amounts costs nothing extra, usage beyond them is deducted from your credits at the prices on the pricing page. A monthly base fee of EUR 3 / USD 3.60 is deducted from your credits; if the credits cannot cover it, Free limits apply for that month.
- Prices and tax. EUR prices include VAT. USD prices exclude sales tax, which is added at checkout where it applies. Your currency is fixed by your first purchase. Payment is handled by Stripe.
- Credits have no cash value. Credits can only be used for hyad services. They cannot be exchanged for money, transferred to another account or sold, except where the law requires a refund (see the Refund and Cancellation Policy). Promotional credits (given by us, not bought) are never refundable.
- Order of use and expiry. Promotional and other credits you did not buy are used first, before purchased credits; within each group, the credits that expire soonest are used first. Purchased credits never expire. Promotional credits may expire as we state when we grant them; we email you 30 days and 7 days before they do.
- When credits run out, usage beyond the included amounts stops at once and Free limits apply (if a base fee was taken that month, the month's included amounts stay until the month ends). Apps beyond the Free app count are paused. Nothing is deleted.
- Custom domains. Pro includes 1 custom domain. More are sold in blocks of 5 domains for EUR 1 / USD 1.20 per block per month, deducted from your credits at purchase and on the first day of each month, whether the domains are used or not. You can reduce your blocks at any time; the change takes effect at once and the current month is not refunded. If your credits cannot pay for a block, the domains beyond what is paid get a 14-day grace period, then the newest are disconnected. A custom domain only serves content hosted on hyad.
- Price changes. We may change prices and plan limits for the future. We announce changes that are worse for you at least 30 days ahead by email. Credits you already bought keep their value in money; usage after the change is priced at the new rates. If a unit price goes up, you may close your account before the change takes effect, without any penalty, and we refund your unused purchased credits (as in section 13).
6. Payment problems, refunds and disputes
- Credits are added only after the payment succeeds.
- If a payment is refunded, the credits it bought are removed (in proportion, for a partial refund).
- If you dispute a payment with your bank (chargeback), your account gets a 14-day grace period; after that, while the dispute is open, Free limits apply and apps beyond them are paused. If the dispute is decided in your favour, the remaining credits of that purchase are removed. If it is decided in ours, Pro is restored. Nothing is deleted.
- Refunds and the 14-day right of withdrawal for consumers are set out in the Refund and Cancellation Policy.
7. Limits, pauses and holds
hyad pauses rather than deletes. Depending on the reason:
| Situation | What happens | How it ends |
|---|---|---|
| A Free monthly limit is reached (requests, CPU) | Your apps (or only your SvelteKit apps, for CPU) answer "paused: monthly limit reached". Sign-in keeps working | Automatically at the start of the next month (UTC), or when you buy credits |
| A SvelteKit app's requests keep running past their CPU limit (often an endless loop) | That app is paused for a while and answers "paused"; we email you. Nothing is deleted | Automatically after the pause (15 minutes today); it is paused again if it keeps hitting the limit |
| The monthly database write limit is reached | Your app databases become read-only: reads work, writes and deletes are refused | Next month, or when you buy credits |
| A database is full | Only deletes run, so you can always clean up | When you free space or upgrade |
| A file or app size limit | The deploy or upload is refused; what is live keeps serving | When you free space or upgrade |
| Credits run out, or a payment is refunded or disputed | See sections 5.6, 6.2 and 6.3 | When you buy credits |
| Admin hold (section 8) | The app, or every app of the account, stops serving; the account cannot deploy, create, start, stop or delete apps | When we lift it |
8. Suspension (admin holds)
- We may put an admin hold on an app or an account if we reasonably believe it breaks these terms or the Acceptable Use Policy, puts hyad, its users or others at risk, or if the law or an authority requires it.
- During a hold, content is kept, not deleted, so it can be reviewed and restored.
- When we place a hold we send you a statement of reasons: what it covers, why, whether it followed a report or our own (including automated) detection, and how to contest it, unless the law forbids it or telling you would defeat its purpose (for example an ongoing fraud investigation). How we moderate, which automated tools we use and what the statement contains is in section 3 of the Acceptable Use Policy. Automated tools can refuse a sign-up or pause an app at a limit, but a person decides on every admin hold.
- You can contest a decision by replying to our notice or writing to
support@hyad.app. A person reviews it. You can also go to court, or to an out-of-court dispute settlement body where one is available.
9. Ending your use of hyad
- You can delete any app at any time. Deleting an app removes it from the internet and deletes its files, database, environment variables, pending uploads and custom domains. Backup copies of its files and its database recovery points are deleted within 30 days (section 11). Its source repository is archived (renamed and set read-only) for 30 days, so that an accidental deletion can be undone by writing to us, and then permanently deleted.
- You can close your account at any time: in the portal (Settings, "Delete account"), or by
writing to
support@hyad.appfrom your account's email address. Your account is locked at once: your apps go offline and you are signed out everywhere. It is deleted with all its apps and their data 30 days after you ask; until then you can cancel, with the link in our confirmation email or by signing in. We then refund your unused purchased credits (see the Refund and Cancellation Policy). To move to another provider, see section 10. - We may end your account with 30 days' notice by email, for example if we stop the service. If we do so without you being at fault, we refund unused purchased credits. We may end it at once for serious or repeated breaches of these terms or the Acceptable Use Policy.
- After termination we delete your apps and their data within 30 days, except what we must keep by law (for example invoices and payment records) or need to keep for security and abuse prevention (for example audit records). The Privacy Policy lists how long we keep what. Export your data before you leave (section 10).
10. Switching providers and exporting your data
You can move your apps to another provider or to your own systems (EU Data Act, Regulation (EU) 2023/2854, Art. 23-31). This applies to every plan.
Switch at any time by asking in the portal or by email to
support@hyad.app. The notice period is at most 2 months; in practice the export is available as soon as you ask.Transition period. After you ask, you have up to 30 calendar days to move your data. Your apps keep running as before during that period, and we help with the switch as far as reasonable. If a switch within 30 days is technically not feasible, we tell you within 14 working days, with our reasons and a new period of at most 7 months. You may extend the transition period once if you need more time.
What you can export. This is the complete list of data and digital assets you can export, per app:
- its files, byte for byte, with their paths and an index (size, type, upload time);
- its database: the schema of its SQL tables (SQL), every row of every table, every document and its sharing settings (JSON Lines);
- its configuration and metadata: name, web address, settings, versions, custom domains, access list, roles and pending invitations, and the names of its environment variables (not their values: keep those yourself);
- its source repository, with full history, through
git clone.
All of it except the repository comes in one step from "Export data" on the app's page in the portal or through the hyad API, as an archive (
.tar.gz) with amanifest.jsonthat describes the contents and formats. The export reads the database while the app runs; stop the app first for a consistent copy. An app with up to 1 GiB of files (20,000 files) gets one archive; a larger app is exported in numbered parts, each its own archive: the first with the configuration and the database (up to 1 GiB), each further one with up to 1 GiB of files (20,000 files), up to 100 such parts (100 GiB or 2,000,000 files in all). Your account data is available under the Privacy Policy. No switching charges. We charge nothing for switching or for exporting your data, including the data transfer (egress).
Afterwards. After the transition period you can still retrieve your data for at least 30 days. We then delete it as in section 9 and, if you ask, confirm the deletion. If you only want a copy and stay on hyad, nothing ends.
11. Backups and availability
- We provide hyad with reasonable care and skill. We do not promise any particular uptime. Consumers also have the statutory rights for digital services (Title 7.1AA of the Dutch Civil Code, Directive (EU) 2019/770): hyad must conform to these terms and to what you may reasonably expect. These rights apply on the Free plan too, because you provide personal data to use it.
- Resilience and deletion. Our storage provider keeps app files and databases redundantly, so they survive hardware and technical failures [[CHECK: Cloudflare's own durability wording for R2 and D1]]. A deletion by you or your app is undone only by a restore: a database can be restored by its owner to any point in the last 30 days. Stored files are backed up every hour; the app's owner can restore them to how they were at a point in the last 30 days, to the hour. A file that existed for less than an hour may not be in a backup, and of a file that changes very often only the 48 most recent earlier versions are kept. Files added after that point are not removed by a restore. A copy of a changed or deleted file is kept for 30 days, then deleted for good. Backups are a safety net, not a guarantee: keep copies of anything you cannot lose.
- We may change, add or remove features. We tell you in advance about changes that significantly reduce what you paid for.
12. Liability
- Nothing in these terms limits liability for intent or gross negligence (wilful misconduct), death or personal injury, or any liability that cannot be limited by law.
- Sole traders only: otherwise our total liability for all claims is limited to the greater of EUR 100 and the amount you paid us in the 12 months before the claim.
- Sole traders only: we are not liable for loss of data you could have prevented by keeping copies, for indirect or consequential loss, lost profits, or for the content and behaviour of apps run by other users.
- Consumers: we are liable for damage that was foreseeable when you agreed to these terms and that results from our failure to perform them or our statutory conformity duties (section 11.1). Sections 12.2 and 12.3 do not apply to you.
- You will compensate us for claims by third parties caused by your content or your breach of these terms (sole traders only).
13. Changes to these terms
We may change these terms. We email you at least 30 days before a change that affects you, with what changes. If you do not agree, you can close your account before the change takes effect, without any penalty, and get a refund of unused purchased credits.
14. Law and disputes
- These terms are governed by the law of [[PLACEHOLDER: governing law, likely the Netherlands]].
- Courts: [[PLACEHOLDER: competent court, e.g. the court of <city>, the Netherlands]].
- Consumers only: you keep the protection of the mandatory law of the country where you live, and you may bring a claim before the courts of that country.
- Contact us first at
support@hyad.app; most problems are easiest to solve that way.
15. Other
- If a clause is invalid, the rest stays in force.
- These terms are written in English only. If we ever offer a translation, the English version prevails.
